摘 要:《民法典》规定的居住权制度,保障了人民群众的基本生活居住需求,满足全体人民住有所居、老有所养的生活愿景,同时也为解决居住权纠纷提供了法律依据。在居住权的设立方式上,房屋所有人可选择以订立合同的方式也可选择以遗嘱的方式为他人在自己的房屋上设立居住权。然而在居住权的存续期限和消灭事由上,《民法典》规定得并不全面。为了更好将该居住权制度落实到实处,维护社会稳定与保障民生,有必要将这些问题予以明确。The residence right system stipulated in the Civil Code guarantees the basic living needs of the people, satisfies the life vision of all people to have a place to live and support their old age, and also provides a legal basis for resolving disputes over the residence right. In the way of establishing the right of residence, the owner of the house can choose to establish the right of residence for others in the way of contract or in the way of will. However, in terms of the duration of the right of residence and the cause of its elimination, the Civil Code is not comprehensive. In order to better implement the residence right system, maintain social stability and protect people’s livelihood, it is necessary to clarify these problems.
