摘 要:国家高度重视未成年人的安全和成长问题并对未成年人监护提供了大量法律支撑。在我国农村地区,存在着大量留守儿童,是未成年人监护的薄弱地带,因此对农村留守儿童监护的监督尤为关键,但是目前我国对未成年人监护的监督机制并不完善。经过实地调研考察,笔者认为司法机关在监护监督机制中处于重要地位,但是司法机关在监护监督中缺乏专门机构,如公安部门对监护的监督呈现单一性、非专门性和滞后性的特点。基于此,应当完善相关立法文件,构建以人民检察院为中心、人民法院和公安机关为重要支柱的监护监督“一梁两柱”的体制,同时与民政部门开展广泛合作,明晰以农村留守儿童为重点关注对象的未成年人监护的监督职责,完善监护监督体制。The state attaches great importance to the safety and growth of minors and provides a lot of legal support for their guardianship. In rural areas of China, there are a large number of left-behind children, which is the weak zone of juvenile guardianship, so the supervision of rural left-behind children is particularly critical, but the supervision mechanism of juvenile guardianship is not perfect at present. After field investigation, the authors believe that the judicial organs play an important role in the supervision mechanism of guardianship, but the judicial organs lack specialized organs in the supervision of guardianship, for example, the supervision of the public security departments presents the characteristics of singleness, non-specialization and lag. Based on this, it is necessary to improve relevant legislative documents, build a “one beam and two pillars” system of guardianship supervision with the people’s procuratorate as the center, the people’s court and the public security organ as the important pillar, and carry out extensive cooperation with civil affairs departments to clarify the supervision responsibilities of the minor guardianship with the left-behind children in rural areas as the focus, and improve the guardianship supervision system.
