摘  要:土地经营权派生于土地承包经营权,土地承包经营权人可以自主决定将该地的经营权通过出租、入股或者让其他方式流转给他人。根据土地经营权抵押权运行的现状可知,《民法典》和《土地承包法》对土地经营权以及土地经营权抵押的章程均不明确和具体,导致我国实现土地经营权抵押仍然存在着诸多困境,如土地经营权抵押权的范围不明确,抵押权人实现其抵押权时面临着较大的困难等。因此,应当通过明确土地经营权抵押权的内容,完善土地经营权抵押权的评估体系等途径细化土地经营权抵押权的法律规定以更好地保障抵押权人有效实现自己的抵押权利。只有将这些问题予以解决,才能实现我国推进农村有效改革、振兴农村经济的目标。The right to land management is one of the characteristics after the promulgation of the Civil Code, which is mainly derived from the right to land contractual management. The holder of the right to land contractual management can independently decide to transfer the management right of the land to others through leasing, shareholding, or other means. The Civil Code ultimately incorporated land management rights into the property rights system, with the aim of actively responding to China’s policy of “separation of three rights”, promoting the development of rural economy in China through a combination of land and financing, while also preventing land from reducing its agricultural value due to population mobility. However, based on the current situation of the operation of land management right mortgage, it can be seen that due to the unclear and specific regulations on land management right and land management right mortgage in the Civil Code and Land Contract Law, there are still many difficulties in realizing land management right mortgage in China, such as the unclear scope of land management right mortgage, and the significant difficulties faced by mortgagees when realizing their mortgage rights. Therefore, how to refine the legal provisions on the mortgage of land management rights and how to ensure that the mortgagee effectively realizes their mortgage rights are the problems that need to be solved in the current property rights section of the Civil Code. Only by solving these problems can we achieve the goal of promoting effective rural reform and revitalizing the rural economy in China.
