摘　　要：农村集体经济组织股权继承有别于一般的财产继承,对于以自治性为原则的农村集体经济组织而言,势必以该问题在有农村集体经济自治“宪法”之称的农村集体经济组织章程中的规范表达为基础展开讨论。以在广州市率先完成集体股权固化的某街道辖区内经济联社章程为样本,对农村集体经济组织股权继承问题在章程中的表达进行考察,结合农村集体经济组织股权的特殊性,梳理出该股权继承问题在章程中的规范表达,引申出对不随人口增减变动而调整股权的静态经营管理模式的反思。同时,通过对章程中股份继承问题具体条款进行解析后,将农村集体经济组织的股权继承问题聚焦到继承人范围、继承内容、继承程序及无人继承的股权处理方式等方面进行详细论述,在现行法律法规框架下的发挥农村集体经济组织章程自治性和引导性作用,为农村集体产权制度改革的开放性奠定基础。Shareholding succession in rural collective economic organizations is different from general property inheritance. In the case of rural collective economic organizations, which are based on the principle of autonomy, the discussion must be based on the normative expression of this issue in the statutes of rural collective economic organizations, which are known as the “constitution” of rural collective economic autonomy. Taking the statute of an economic association under the jurisdiction of a street which has taken the lead in completing the solidification of collective equity in Guangzhou as a sample, the expression of the issue of shareholding succession of rural collective economic organizations in the statute is examined. Further, rethinking the static business management model that does not adjust equity in response to population growth and decline. Through the special characteristics of the equity of rural collective economic organizations, sorting out the normative expression of this shareholding succession issue in the statute, and focusing on the scope of the heirs, the content of the succession, the succession procedure and the way of handling the equity of the uninherited are discussed in detail. The autonomous and guiding role of the statutes of rural collective economic organizations, within the framework of existing laws and regulations, lays the foundation for the openness of the reform of the collective property rights system in rural areas.
