摘　　要：近年来,无论是理论学界还是司法实务界,关于数字货币金融犯罪的治理均处于问题暴露阶段,缺乏系统又深入的路径规制和司法适用研究。正因如此,研判刑事犯罪典型案例、归纳数字货币裁判难点,开展犯罪治理对策研究,对我国准确适用法律规制数字货币犯罪、维护社会主义市场金融秩序具有重要意义。本文选取了全国范围内已发布的、罗湖区院已判决的涉及数字货币刑事典型案例为样本,阐述财产概念流变、支付方式演进对我国现行法律框架的影响,以及显现出的司法适用、监管空白、金额认定、追赃挽损等评价障碍,试图在厘清刑法意义上财物概念的基础上,以数据为基础,以问题为导向,研究以财产犯罪规制的可能性,同时从行政立法、司法解释、国际合作上探索构建刑法规制与司法适用的核心机制。In recent years, Whether in the theoretical or judicial practice, the governance of digital currency financial crimes is at the stage of problem exposure, and there is a lack of systematic and in-depth research on regulatory pathways and judicial applications. Therefore, it is of great significance to study typical cases of criminal offenses, summarize the challenges faced in digital currency judgments, and carry out countermeasures research on criminal governance, so as to accurately apply the law to regulate digital currency crimes and maintain the socialist market financial order in China. This paper selects the typical criminal cases involving digital currencies that have been released nationwide and judged by the Luohu District Court as samples, expounds the impact of the evolution of the concept of property and the evolution of the payment method on the current legal framework of our country, as well as the obstacles in the evaluation of the judicial application, the regulatory gaps, the determination of the amount of money, and the recovery of stolen assets. By doing so, this paper attempts to clarify the concept of property in the sense of criminal law and, on the basis of data-based and problem-oriented research, to study the possibility of regulating property crimes, while exploring the construction of a core mechanism for criminal law regulation and judicial application in terms of administrative legislation, judicial interpretation and international cooperation.
