摘　　要：从文化学的视角看,调解根深蒂固的原因一是文化传统的积淀,这是民族性的;二是人类对和谐的追求,这是世界性的;三是对人性美的呼唤,这是普适性的。调解建构中现存的缺陷主要是因为文化概念的混淆,文化生活的变化,文化心理的影响,一方面是对调解本身的理解缺乏周全的通盘考虑;另一方面是制度设计与当下的形势不合拍。"美在和谐"的命题启示我们,在调解制度的建构上,应谨守和谐情怀去设计调解制度,按照"美的规则"去建构调解文化。现实生活中应尊重民族文化传统,分析现代社会形势,顺应民心民情,批判吸收国外ADR的经验,对调解规范化、制度化、人性化、细致化、具体化,实现传统固有的社会规范上升为现代的法律规范,依靠法律,形成新的社会规范。From cultural perspective,the deep-rooted reasons of mediation: first,is the cultural tradition of the accumulation,which is the national;second,is on the pursuit of harmony,which is the world;third,is human nature calls for aesthetics,which is universal in nature.As for existing deficiencies of building the mediation system,mainly because of the confusion to the cultural concept,and cultural life changes,cultural and psychological impact;On one hand the understanding of the mediation lack of comprehensive ...
