摘　　要：《刑事诉讼法》第82条的规定有很多问题。对"法定代理人"的规定存在和其他法律不一致、概念混淆、列举项涵盖以及未明确"被代理人"范围的问题;对"近亲属"的规定存在范围过窄、表述不当的问题;对"诉讼代理人"的规定存在表述烦琐重复的问题;对"诉讼参与人"范围的规定遗漏了保证人、见证人;对"侦查"则没有必要规定在本条中。Many problems exist in Article 82 of Criminal Procedure Code.
