民事执行调查程序基本理论分析

摘　　要：为迅速查明被执行人的财产,保证民事执行的准确、高效,构建完善的执行调查程序愈加突显其必要性。执行调查程序是查明被执行人财产状况的事实发现程序,其核心是,法院执行调查的权力与当事人执行调查的义务。该程序具有规制执行调查行为、促使被执行人履行生效法律文书确定的义务等方面的功能。In order to identify the property of the person subjected to execution rapidly,and ensure the execution of civil affairs accurately and efficiently.It is more necessary to build a perfect procedure of investigation in the civil execution.Investigation procedure in execution is the fact finding one,it identifies the property of the person subjected to execution,the core of investigation procedure in execution is the relationship between the power of court and the rights and obligations of parties,this procedure has the function of regulating the investigation conduct in execution,prompting the person who subjected to execution to perform the obligations to effective legal documents.
