摘　　要：一、法治与人治体现了两种不同的权力价值观和两种不同的管理制度依法治校,就是依照教育法律、法规所规定的权限和程序来管理学校。从教育法规的作用形式来看,依据教育法律规范来约束管理对象的教育行为和约束管理者自身的管理行为是依法治校不可分割的两个方面。从学校主体看。Rule by law and rule by man are two kinds of views of power and two kinds of adminis- trative behavior under two kinds of systems. Rule by law,not opposite to rule by man,is truly opposite to autocracy. Ruling schools according to law has social and education values. The realization of ruling schools according to law requires some material conditions and the process of renewing concpets.
