孟子法律思想与社会契约论的相通之处

摘　　要：孟子的法律思想蕴涵了自然法的特质,尤其是社会契约论的基本理念,其中论及"民"乃平等与自由的民众的"有民才有国"、论证君主保护民之财产及发动正义战争和民为贵思想的"仁者无敌"、"世代相传"三大方面的理论体现了社会契约的签订、履行和有效的契约理念,呈现出孟子法律思想与社会契约论的相通之处。Mencius's legal thoughts are pregnant with qualities of the natural law,especially the principles of social contract.Mencius regarded the common people as free and equal civilians without whom there would be no state.He argued that monarchs should protect the properties of the common people.He contended that wars when waged should be just,the life of common people was valuable,benevolent governance had no enemy,and properties and virtues should be allowed and encouraged to go on forever in the family.These views reveal the signing and performing of valid social contracts,parallel to the western theory of social contract.
