摘　　要：在我国,签订书面合同的比例不高、突破用工界限、工资标准违规、社会保险等福利待遇低是非标准劳动关系中劳动者权利受到侵犯的主要形式,造成劳动者权利受到侵害的主要原因是由于我国目前劳动者的权利保护体系不健全,只有落实现有法律法规,完善相关立法,规范司法实践,完善理论基础才能构建完善的对于非标准劳动关系中的劳动者而言全面、有效的权利保护体系,推进非标准劳动关系的全面发展。In the nonstandard labor relation,the workers' rights in China are infringed as follows: the low proportion of signing written contracts,breaking the employment boundaries,violations of wage standard,low social insurance and other benefits. The reason why workers' rights are violated is mainly because the protection system of workers' rights in China is imperfect. Only when the existing laws and regulations are implemented,the relevant legislations are improved,the judicial practice is standardized,and the theoretical basis is perfected can the comprehensive and effective protection system be built,so as to promote the comprehensive development of workers' rights under the non- standard labor relations.
