摘　　要：本文阐明了高等教育与高等教育法的关系。依法办学、依法治教是社会改革发展的必然趋势,是高等教育发展规律的要求,是高等教育规模、质量、结构、效益协调发展的要求。同时也阐明了高等教育进一步改革发展需要不断完善高等教育法律体系。This paper emphasizes that all higher educational operations, from administering the whole university to organizing a paticular teaching activity,are supposed to get under the control of the HIGHER EDUCATIONAL LAW. The arising of such a situation owes much to the development of our social reform and goes inevitably with the construction of our social legal system. An effective higher educational law is needed for the development of our higher education-the coordinate development of its scale,quality,structure and profit. This paper also points out that the higher educational law system needs to be further improved for the reform and development.
