WTO安全例外条款的完善与我国装备发展对策

摘　　要：本着国家安全优先准则,世界贸易组织在世界贸易协定中设有"安全例外条款".凡涉及到国家安全利益,为保护国家安全利益所必需的措施,可以作为WTO的例外.但这并不意味着入世对我国装备发展没有影响.分析了WTO安全例外条款现存的法律漏洞、安全例外条款的完善以及安全例外条款对装备发展的影响,提出了应加强对安全例外条款的研究,制定相应的贸易防范措施,以促进我国装备的发展,维护国家安全利益.According to the guide line of priority of state security, the Word Trade Center (WTO) sets up the 'security exception items' in the world trade convention. The necessary measures about the state benefits may be regarded as WTO security exception. But it does not imply that entering WTO has no effect on our equipment development. The paper analyzes the existing legal problems, the improvement and the effect on the equipment development of WTO security exception items. It offers that we should strengthen the research, work out the corresponding measure to protect the trade, improve our equipment development and protect the state security benefit.
