摘 要:商品房预售合同是不同于西方国家房屋按揭合同的新式合同,它以预购方向销售方融资的方式,有效解决了销售方的资金问题,也因此给消费者带来了先天保护不足的弊端。目前通说是把预售合同认定为买卖合同,但从预售合同本身的特点以及保护消费者权益的角度看,将其厘定为承揽合同更为恰当。由于现行法律的漏洞,对消费者无法全面保护,同时预售合同的格式化易于使消费者在签订合同时落入"陷阱",这种风险是消费者应注意防范的。The contract of the preselling of the merchandise building is the modern style contract that differs to the mortagage contract of building in west nations, which resolves the funds of the seller in the way of financing from the subscriber to the seller, but it brings to the disadvantage of protectting the consumer. The general theory recognize the preselling contract to business contract , but from the characters of the contract and the protection of the consumers' rights , it's better to define it as work contract. Because of the leaks of the current law and the format contract, the consumer can't be protected completely , so it's necessary to against falling into the trap when singing the contract.
