摘　　要：本文首先论述了区分职务作品与非职务作品的意义,进而阐释了我国著作权法区分职务作品与非职务作品的标准,并对职务作品与相关概念进行了界分,最后,对我国现行法区分职务作品与非职务作品的标准作了研讨。This article expounds the significance of defining post works and non-post works. On the basis, It elaborates the standards of judging pos t works and non-post work s in the copyright law of China, differentiates the post works and the concerned concepts, and discuss the standards of definition of post works and non-post works in the Chinese law.
