摘　　要：对于犯罪构成理论的整体性把握,应以犯罪构成具体要件的确定为切口,从犯罪构成的概念入手,在犯罪构成理 论的历史形成、体系的中外比较、现实的运用状况、指向的哲学反思四个方面对其进行整体性把握。在这一整体 视野下,可以探视到我国传统犯罪构成理论体系之一部分即犯罪客体理论之体系结构的繁冗、功能发挥的混淆和 作用产生的空置等诸多方面的缺陷、矛盾与不足,从而明确改造传统犯罪构成理论的方向之一即传统犯罪客体理 论。对于犯罪客体理论的改造,则从其定义入手,将其重新定义为法益,并置挪到犯罪概念下去研究,使其重归原 位;同时,将犯罪主体要件与犯罪主观要件相合并,从而将传统的犯罪构成四要件说改造成为二要件说,以进化完 善我国的犯罪构成理论。以法益作为犯罪客体的实质内容,则有消除体系混乱、统合刑法作用、指示理论方向、符 合时代精神等诸多"社会关系"说所不可比拟的优越处。Regarding the crime constitution theory integrity assurance, We should indeed decide as the margin by the crime constitution concrete important document, obtains from the crime constitution concept, forms, the system Chinese and foreign comparison, the reality utilization condition, the directional philosophy in the crime constitution theory history reconsiders four aspects to carry on the integrity assurance to it. Under this overall field of vision, may visit to of a part our country tradition crime constitution theory systems is system of structure the criminal object theory complicated, the function display confusion and the function spawn vacant and so on many aspects flaws, the contradiction and is insufficient , thus is clear about one of transformation tradition crime constitution theory directions is the tradition criminal object theory. Regarding criminal object theory transformation, then obtains from its definition, redefines it as the law profit, the juxta position moves to the crime concept gets down the research, causes it to turn over to the home position again; At the same time, coincides the subject of crime important document and the crime subjective important document and, thus constitutes the traditional crime four important documents to say transforms into two important documents to say, by evolves consummates our country the crime constitution theory. Takes the criminal object by the law profit the substantive content, then has the elimination system chaotic, the series gathers the criminal law function, the instruction theory direction, conforms to the spirit of the age and so on many 'the social relations' to say incomparable is superior place.
