论我国普通高校与学生的法律关系

摘　　要：我国普通高校是法律法规授权组织,对学生行使一定的行政管理权。其与学生最基本的是行政法律关系,其中,在学籍管理,毕业证书和学位证书的发放,档案管理,留校察看、勒令退学和开除学籍处分等方面是外部行政法律关系;在奖励,警告、严重警告和记过处分,校园秩序管理,与专业知识有关的管理等方面为内部行政法律关系。此外,在公产管理,学生公寓租用,饮食服务和学生校园伤害等方面与学生之间为民事法律关系。Universities in China are organizations authorized by laws and regulations to exercise certain administrative power over students. The basic legal relationship between a university and its students is administrative law relationship, including the external law relationship as seen in school roll management, file management, conferment of graduation certificate and degree certificate, probation within the school, ordering a student to leave the school and being struck off the school roll, etc., and the internal law relationship as seen in award, warning, serious warning and demerit punishment, management on campus order and management related to their majors, etc.. In addition, civil legal relationship also exists between universities and their students, such as management of property, rent of student apartment, meal service and students' harm on campus.
