摘　　要：刑法第306条规定的辩护人伪证罪对刑事诉讼基本结构、回避制度和证明规则造成了很大冲击,使辩护人和所有受刑事追诉者的正当权利受到威胁,同时也是对辩护权的侵蚀。通过从刑事诉讼程序法及其相关制度的角度对该罪进行分析,笔者以为该罪名应当废除。The article 306 of criminal law on crime of perjury by defender has made a great impact on the basic structure of criminal procedure, the challenge system and the certification rides. It also causes damage to the due right of the defender and all the accused, and the right to counsel has been corroded. From the angle of criminal procedural law and the correlative system, this crime should be abolished.
