摘　　要：非户籍常住人口子女的义务教育权是其基本人权。落实非户籍常住人口子女的义务教育权,是建构和谐社会的基本要求。针对现行政策法规存在的二律背反问题,应加强国家和地方相关立法,对“两个为主”政策进行适当修正,并建立起中央财政对非户籍常住人口子女义务教育经费的转移支付制度。The right to compulsory education to the children of non- native residents is attributed to the fundamental human right. To ensure the right to compulsory education to the children of non -native permanent residents is a basic need for the construction of a harmonious society. Aiming at the ambivalence and incoherence of some items in State Law and Education Law, the authors consider that the enforcement of the legislation of relevant national and local laws and the revision of some policies are highly necessary so as to establish a state fund and realize a system of transference payment to the compulsory education to the children of non - native permanent residents.
