摘　　要：医学教育临床教学实践,由于医学教育规律的特殊性、我国医学人才培养的特殊历史发展过程和有关法律建设的缺陷,陷入了必须进行而又事实违法的困境中,其影响面之广、影响程度之深、法律风险之大,已经造成了医学教育发展的困难,也会损害相关主体的权益。因此,从政策法规上解决这一问题已经是势在必行。On one hand, medical education has its own educational principles, on the other hand, China＇ s system in medical education has developed over a special historical period and there exist some defects in the construction of laws related to medical education. Consequently, the clinical practice of medical education faces a dilemma： it＇ s necessary, at the same time, it＇ s illegal. This dilemma has brought about many difficulties over the development of medical education with its high - degree effectiveness and high legal risks. Therefore it＇ s time to solve the problem with policy and laws.
