摘 要:高校后勤社会化改革,吸引了大批社会企业投资建设高校学生公寓,并由其提供学生入住后的一系列消费服务,甚至也参与到学生公寓的管理过程中,打破了原有的高校与学生之间的单项法律关系。通过对新形势下,高校、学生、投资企业三方之间法律关系的简单分析,可以为依法治校、尊重和维护大学生合法权益提供理论依据。The socialized reform of university logistic service has attracted a large number of socialized enterprises to invest the apartment construction for university students. Meanwhile, these enterprises also provide the accompanying consumptive service in the duration of students'living from the very beginning. They even participate in the management process of the students" apartments. All of these factors have broken out the originall single legal relationship between university and students. This paper aims at providing rationale for governing university legally as well as respecting and protecting the legitimate rights of university students by analyzing the tripartite relationship among universities, students and investment enterprises in the new situation.
