摘  要:教育公益诉讼是检察机关、社会组织、公民个人等作为公益共同体的形式当事人,对教育领域内违反教育法律法规、侵犯国家或社会公共利益以及公民受教育权等合法权益的行为,依法提起的新型诉讼。提起教育公益诉讼应当具备三个条件:案件属于教育公益诉讼的范围;诉讼请求中具有明确的保护国家、社会公共利益的内容;存在一个能够代表公共利益的诉讼主体。Educational Commonweal Pleading is a new kind of litigation. In this litigation, as the formal parties of the commonweal community, the prosecution organs, social organizations,individuals and so on could institute a suit against such actions, which break educational law or code,infringe upon the public interests of the nation or society,the educated rights and legitimacy rights and interests elseof the citizen in educational field. When we bring educational commonweal pleading, we must have three conditions: first, the case is included in the scope of educational commomweal pleading; second, has unambiguous content of protecting the public interests of nation or society in petition; third, exists a subject of litigation that can delegate the public interests.
