摘 要:近年来,日益增多的教育纠纷迫切需要可以凭借的纠纷解决机制予以处理和疏通。教育纠纷的成因主要是:高校主体对学生主体的平等法律地位的意识不够;教育行政法律法规严重滞后,学生权利保障的法律法规缺位;高校及其内部机构“立法”越位;高校管理者与学生在处分权的认识上存在差异及教育纠纷本身具有特殊性;学术权力行使过程中存在着绝对性、无序性和随意性等。为此,应加强高校自身对教育纠纷处理的约束控制;加强教育行政部门对教育纠纷处理的介入;畅通诉讼途径,加强司法机关对教育纠纷的有效审查。In recent years, the increasing number of educational disputes is in bad need of a reliable meehanism. The main causes of educational disputes are: the insufficient awareness of equal legal positions between universities and the students on the side of universities, the backwardness of educational laws and regulations, the lack of laws to proteet r students' rights, the overstepping of ‘law-making' in universities and its inferior authorities, difference in the understanding of disciplinary-actions between university administrators and the students, the features of educational disputes, and the presence of absoluteness, chaos and randomness in the execution of academic powers. Hence, it is necessary to ence of educational administrations in the strengthen universities' control over and the interferhandling of educational disputes, the and effective inspection of judicial authorities on educational disputes.
