摘 要:十多年前,山西“维尔康”与北京“北冰洋”食品公司的“维尔康”商标之争震惊了整个食品业,经过政府有关部门协调当事双方最终总算达成共识;2007年9月初国内方便面粉丝生产龙头企业——四川自家食品有限公司与河南方便面行业的佼佼者河南白象集团开始了维权之争,同年11,四川白家在山东潍坊市正式提起法律诉讼。这场官司的输赢并不重要,或许是捍卫自己的权利,或许是炒做,但有关商标、专利权、In China,the awareness of intellectual property right is gradually raising,but we still encounter outstanding challenges. China has jointed in WTO for 7 years,multinationals and import products keep surging into Chinese market,while domestic firms also try to introduce their products to the world. It is undoubtedly beneficial but we must learn to protect brands by the means of legal safeguard. Generally,intellectual property rights have been regarded as a strategy emphasized by a number of countries.And the range of protection keeps enlarging.But patent approval trends to be monopolized.by the countries having predominance. Therefore,the enterprises shall promote market strategies, compete with rivals,ensure self-protection and maximize profit by legal means. China increasingly takes intellectual property rights pro- tection serious,which provides an advantageous environment. The firms shall grab this opportunity to learn related knowledge and improve staff competence over-all.Although intellectual property rights protection is typically two-fold,it is still an efficient weapon to guard our famous brands growing up in the global market safely.
