摘　　要：期待可能性理论在德、日等大陆法系国家得到了广泛的认可和运用。近年来,我国刑法学界已开始涉足期待可能性理论,并取得了一定的研究成果,但在很多方面尚存在比较大的争议。由于我国刑法理论的特殊性,我们应当把期待可能性理论放入我国的犯罪论体系中来研究,并以综合标准判断在具体案件中期待可能性的有无。The theory of expected possibility has been widely acknowledged and utilized by Germany, Japan and others. In recent years, some Chinese scholars have started their research on it and have achieved some results, but there are still some controversies in many aspects. The author will study the theory including its theoretical basis, standard and status in the criminal law system.
