摘　　要：现行宅基地使用权制度在申请取得、继承以及流转等方面都存在缺陷。这些缺陷源于现行制度所赖以存在的城乡二元社会体制的改变。宅基地使用权制度创新的现实基础是宅基地所具有的双重功能,即生存保障功能和经济发展功能。必须明确区分宅基地权利制度和管理制度,制定专门的宅基地使用权申请取得规则和有偿使用制度,并允许其自由转让。There are defects in the current system of right to use house sites in the aspects of applying, inheriting and circulating. These defects stem from the change of the dual system of urban and rural areas that the present system relies on. The base of the innovation is the dual functions of house sites, namely, functions of living insurance and economy development. We must distinguish the systems of right and management to house sites, make special applying rules and compensated usage system and allow it to transfer freely.
