摘　　要：教育仲裁作为一种具有公正性、专业性和效益性的纠纷解决机制,以其所具有的成本低廉、程序简便、专业性强等优势顺应了教育纠纷解决的需要,是建立和完善我国多元化教育法律救济体系的重要内容。通过对教育仲裁制度进行价值分析和国外仲裁性教育纠纷解决机制进行比较研究,对我国实践中教育仲裁制度的构建和教育法律关系主体的权利保障将有所裨益。The education arbitration is a system that solves the education disputes, having the characteristics of fairness, technicality and efficiency. The education arbitration occupies an important position in the multiplex legal relief system. Aiming at the current status, the essay tries to propose the concrete content which the education arbitration system should have through analyzing the value of the education arbitration and comparative studying the arbitral mechanism for settling education disputes. The author hopes to promote the legal construction of the education arbitration in China.
