摘  要:今年6月29日,第十届全国人大常委会第二十八次会议审议通过了《中华人民共和国劳动合同法》,劳动合同法的出台不仅对企业的劳动关系、人力资源管理模式将产生重要影响,而且会对事业单位的用工方式、合同关系管理带来重大变革。对劳动合同和聘用合同进行了研究,重点比较了二者在合同的订立、履行、变更、解除或者终止,经济补偿金的给付等方面的异同。This year, on June 29, the 28th of the 10th meeting of the NPC Standing Committee examined and adopted the “People's Republic of China labor contract law”, Labor Contract Law is not only the introduction of the enterprise labor relations, human resources management will have an important mode impact, and will have employment in public institutions, a contractual relationship management bright about major change, labor contract and employment contract will be studied, focusing on the comparison of the two made in the contract to fulfill, change, lifting, termination, economic compensation the payments, and other aspects of the similarities and differences.
