摘　　要：刑事审判作为一种正义的实现过程,蕴涵丰富多姿的美,其中的戏剧美最为显著,戏剧艺术表现的综合性与刑事审判蕴涵的多种美的表现形态相通,戏剧集中反映矛盾冲突与刑事审判的对抗性暗合,戏剧表现形式的多样性与刑事裁判类型的多元化对照。发掘刑事审判的戏剧美旨在通过直观的认识来发现刑事审判美的秩序,探求这种秩序形成的审美动因,并为刑事审判构建提供某种可以参照的美学标准和原则。The criminal trial, as a kind of form to realize justice, contains rich and varied beauty, among which the dramatic beauty is the most remarkable. The comprehensiveness embodied by the dramatic art shares some characteristics with the various beauties con- tained in criminal trial, the contradiction and conflict reflected through drama agree with the antagonism of criminal trial, and the variety of dramatic expression forms is corresponding to the diversification of criminal judgment types. The aim of exploiting the beauty of criminal trial is to find out the order of beauty of criminal trial through direct cognition ,to explore the aesthetic motivation of forming this order,and to provide some aesthetic standards and principles to which can be referred for the construction of criminal trial.
