摘 要:法律规定劳动者单方解除劳动合同权的目的,在于保护劳动法律关系中处于弱者地位的劳动者,维护劳动者自主择业的权利,以实现劳动力价值最大化。劳动者单方解除权制度体现了自由择业的精神,但也存在诸多缺陷。在我国现有的法律体系中,《劳动法》相关的规定主要体现在第31条和第32条,新颁布实施的《劳动合同法》也只是对劳动者单方解除权行使的情形和法律责任作了些补充,其余都散见于劳动部规范性文件或者地方性立法中,立法层次较低,条文过于简单,操作性不强,实践中纠纷不断。The purpose of regulating the labor's unilateral right of relieving the contract is to protect the labor who is the weaker in the labor legal relationship, to protect the labor's fight of freely choosing the job, to maximize the labor's value. The system of labor's unilateral right of relieving the contract embodies the spirit of the freedom to choose the job, but it still has many defects. In our current legal system, the article 31 ,article 32 of Lahor Law regulate the above right, the new issued Labor Contract Law just regulate the legal liability and in what circumstances the labor's unilateral right of relieving the contract can be exercised, other regulations can be seen in the documents issued by Labor Department and regional laws. The legislation level is very low, the regulations are very simple and are not easy to operate, which have caused continuous disputes in the practice.
