摘  要:劳动争议调解仲裁法的出台对规范劳动合同关系、完善劳动用工制度、解决劳动争议纠纷、构建和谐劳动关系起到十分重要的促进作用。但笔者认为,新法对解决劳动争议具有重要作用的仲裁与诉讼关系仍然未能有效理顺,这必然为今后发生劳动争议的解决埋下隐患。笔者主张废除"仲裁前置"程序,确立"裁审分离"制,并提出相应的改革举措。The release of Labor Dispute Mediation Arbitration Act plays a very important role in standardizing labor contract relations,pecfecting the labor system,solving the labordispute,and constructing the harmonious laborrelations.However,the author believes that the new law has not effectively straightened out the relationship between arbitration and lawsui.The relationship is very important to solve the labor dispute, this inevitably lays down hidden danger for the solution to future labor dispute.The author advocates abolishing the procedure of "the arbitration pretage" ,and establishing the system of "the separation of arbitration and trial" ,and then proposes the corresponding reform action.
