摘　　要：高校学生与高校之间的法律责任应该以法律关系为基础,对此有"监护关系说","准行政关系说","教育契约关系说","教育管理关系说",从公平、合理、合法等方面来评价,高校学生与高校之间的法律关系应该是教育管理关系。The legal responsibility between college students and colleges and universities should be based on legal relationship, so there are＂ guarding relations＂, ＂quasi - administrative relations＂, ＂education contractual relations＂, ＂education management relations,＂ from the angles of fairness and reasonableness to evaluate, the legal relationship between college students and colleges and universities should be education and management relations.
