试论高校在校外勤工助学管理中的法律地位

摘　　要：通过分析目前高校对校外勤工助学的管理现状,探讨高校在校外勤工助学管理中的社会中间层主体的法律地位,明确高校在管理中享有规章制定权、推荐权、监管权、非法律惩罚权等职权与权利,承担审查、岗前培训、合理使用专项经费等职责与义务,从而规范和完善其管理,切实保障校外勤工助学的大学生的合法权益。By analyzing the status quo of the management of off campus part work and part-study, this paper explores the legal status of colleges/universities in the management of off campus work-study as the main social middle layer, and points out that colleges and universities enjoy the right to formulate regulations, the right of recommendation, the right to custody and the right of non-legal punishment, and undertake the duties and obligations of investigation, pre-job training, and proper use of special funds. In this way, the management will be improved and standardized, and the legitimate rights and interests of the off-campus student workers will be better protected.
