摘 要:派遣劳动者作为劳务派遣关系中的一方主体,在执行职务的过程中致人损害时我国现有的雇主责任规则难以适用,由此,在未来的侵权责任法中对其雇主责任应规定如下:在外部责任的承担上,派遣单位和要派单位承担连带赔偿责任。在内部责任承担上,派遣劳动者承担重大过错责任;派遣单位与要派单位有约定的依约定承担,无约定或约定不明时,派遣单位承担选任雇员的过错推定责任、要派单位承担无过错责任。As one of the legal subjects in the placement, when the Placed employee infringe upon others' fights on their duties, China legal rule of Vicarious Liability can not regulate it. it is suggested that the future Tort Liability Law should enacte some provisions to regulate the vcarious liability of placed employee as follows: As for file victims, the Staffing Firm and the Accepting Unit should be jointly and severally liable for damages. As for the legal sujects of the placement, placed employee should undertake the grave fault liability, and the Staffing Firm and the Accepting Unit may stipulated the apportionment of vicarious liabihty in the staffing agreements, if they did not stipulate it or not stipulate clear, the staffing finn should shoulder the presumed fault liability of hiring employee, the accepting units should take the no- fault liability.
