摘 要:我国地方政策在解决民办学校教师编制与户口、工资、养老保险、在职培训、教师在公办学校和民办学校之间流动等问题上较国家立法有明显突破和创新。但由于地方政府对民办学校教师身份存在认识偏差,对民办学校教师权益保障机制缺乏系统构建,民办学校教师权益难以得到充分保障。完善相关地方政策,需要从法理上明晰民办学校的性质定位以及民办学校教师的法律地位,在此基础上实现对民办学校教师权益保障机制的系统构建。Local policy in China has made more significant breakthrough and innovation than national laws on such issues as nonpublic school teachers' personnel establishment, registered resident, salary, health care, in-service training, and teachers' flow between public school and non-public school. Because of understanding deviation of identities of non-public school teachers and because of lacking systematical "teachers' rights and interests security mechanism", non-public school teachers' rights and interests are difficult to be guaranteed fully. To improve relevant local policies, it need clarify the nature of non-public school and teacher's legal status. Based on it, non-public school teachers' rights and interests security mechanism can be constructed..
