摘　　要：人事诉讼裁判并非追求一个简单的"非黑即白"的结果,在适用程序、价值取向、诉讼法理等方面与普通民事案件存在诸多不同。文章从人事诉讼程序的设立模式、涉猎对象、特别法则以及裁判机构等多角度进行论析,提出了设立具有中国特色人事诉讼程序的初步构想,旨在为中国今后架构专门人事诉讼程序作理论上的铺垫。The verdict of domestic proceedings is not the simple pursuit of the result of ＂black or white＂, which has many differences from general civil cases on the perspectives of the application of the procedures, values, and procedural laws. By using the occasion of amending the Code of Civil Procedure, it＇ s necessary to construct the domestic proceedings according to China＇ s national conditions, and establish the models, the targets, the special laws, and the special judgment agency of the domestic proceedings.
