摘　　要：近年来我国与计算机软件相关的专利数量在专利总拥有量中的比例大幅提高,软件专利的合理使用问题日益引起关注。因此在界定专利合理使用制度内涵和适用范围的基础上,分析软件专利合理使用制度的价值和判定标准,并以反向工程为例,探讨适度扩张软件专利合理使用的范围对我国软件产业的发展具有积极意义。The fair use system aims at stimulating innovation, promoting economic development and social progress by coordinating the interests between intellectual property right-holders and the public. In recent years, the number of patents which are related to computer software is increasing, and the fair use of software patents arises public attention. Therefore, on the basis of defining the content and application scope of the patent fair use system, analyzing the value and standard of software patent fair use system, and taking reverse engineering as an example to discuss expanding the scope of software patent fair use system are of positive significance to the development of our country＇ s software industry.
