摘　　要：高校是法律和法规的授权组织,具有行政主体资格,在授权范围内行使国家行政与行政管理的权力,这就决定了高校必然拥有行政自由裁量权,但其范围是有限的。高校自由裁量权设定的最初目的是为了提高行政效率,但高校自由裁量权的价值取向,必须体现公平和效率的平衡。The institution of higher learning is an organization authorized by laws or regulations with the administrative subject qualification. Within the scope of the authorized power, institutions of higher learning can carry out the national administrative power and executive power, which decides that institutions of higher learning inevitably hold the limited administrative discretionary power. The original purpose for the setting discretionary power in institutions of higher learning is to enhance administrative efficiency, but the value orientation of discretionary power in institutions of higher learning has to embody the balance of equity and efficiency.
