论检察机关对人事诉讼的一般参与制度

摘　　要：人事诉讼程序是将身份关系上的争议作为调整对象,为实现身份关系的和谐与稳定,大陆法系国家从立法上认同了检察官参与人事诉讼,以实现对职权探知的必要补充。检察官的一般参与不仅可列席人事诉讼裁判并陈述意见,还可以提出新的事实主张及证据方法。就检察机关参与人事诉讼制度的法理、国外立法现状以及参与方式等内容从比较法的角度进行阐释。将检察官的参与制度引入人事诉讼,不仅有利于人事诉讼程序价值目标的实现,提升程序的公信力,更有益于诉讼经济以及人事诉讼社会功能的承兑,同时为人事诉讼判决既判力扩张的正当化提供制度上的保障,较好地保护承受判决对世效第三人的合法权益。Domestic legal proceedings regards the controversy over the identity relationship as the object for adjustment. In order to maintain the stability and humanity of the relationship between identities, from the perspective of legislation, some civil law countries generally agree with that prosecutors can participate in the domestic legal proceedings for realizing necessary complement to find out the power of authority. The general involvement of prosecutors can not only participate in domestic legal proceedings verdict and make the presentation, but put forward new ideas and evidences. From the point of comparative law, this thesis focuses on the legal principles of the procuratorial organs involvement systen~, current legislative status of other countries, and the ways of involvement and so on. The thesis states clearly that if the procuratorial organs involvement system can be introduced into domestic proceedings, it will be good for the realization of goal＇s value of domestic proceedings, for enhancement of public trust of proceedings, even for economy of procedures and credibility of social functions of domestic proceedings, for the system protection on the justification of the expansion of current effectiveness of domestic legal proceedings verdict, so that it can protect the legitimate rights and interests of the third party, who bear the validity of the domestic legal proceedings verdict.
