警检关系的重构与公诉预查制度的构建

摘　　要：刑事诉讼法的修改强化了控辩双方的对抗性,作为控辩双方争议焦点的证据在整个诉讼过程中的地位更加重要,而律师法的修改更是对公诉机关用于证明犯罪事实的证据提出了更高的要求,但在目前我国实行的侦查中心主义的模式下,公安机关所收集的证据往往不能达到庭审证案的要求,为此应构建公诉预查制度,既要明确公诉预查的范围和介入时间,又要明确公诉预查的机构组成、预查方式、内容和效力等,从而更好地改善我国警检关系,提高侦查起诉效率,确保案件质量,实现公正与效率的有机结合。这既符合我国的警检关系现状,也符合公正和效率的要求。The amend of Criminal Law strengthens the opposability of the prosecution and defense, meanwhile the evidence as the focus of the prosecution and defense＇ s dispute takes a more improtant role. Moreover the amend of Law of the People＇ s Republic of China on Lawye puts higher demands to the evidences. However the evidence from police often can not accord with the needs of court. Thus we need to build system of pre-spy in public prosecution. The system should definite not only the range and intervening time but also the organization, the mode , content and effectiveness of pre-spy etc. , which can polish up the relationship between police and procuratorate, improve the prosecuting efficiency.
