摘　　要：在我国立法实践中普遍存在着这样一种现象:甫一制定出的法律就遭到质疑甚至普遍的批评。这不禁让人思考,难道立法者对这些不足和缺陷都视而不见吗?在法律的制定过程中究竟哪些因素影响了立法,进而决定了法律的样貌呢?场域理论提供了一种可能的途径,以《诉讼费用交纳办法》的制定过程为例,回到立法的场景中细致考察这些因素,我们或许能够更清楚地认识和评价立法。There is a common phenomenon in the legislation, the new law is criticized just after its promulgation, which is worthy of reflections. Are these problems ignorant to the lawmakers？ What factors influence the legislation and the law？ The theory of field by Bourdieu provides a possible way to analyze these factors at great length. Returing to the legislative process of Measures on the Payment of Litigation Costs, we may give a more accurate judgment of the law.
