摘　　要：劳务派遣是一种重要的用工形式,在我国发展迅速。虽然2008年1月1日实施的《劳动合同法》及其实施条例对此构建了框架性的规范,使劳务派遣进入了法治轨道,但通过两年来的实践检验,我国现有的劳务派遣法律制度尚不能满足现实的需要,还有需要完善的地方。As an important form of employment, Labor dispatch is developing rapidly in China. Although Labor Contract Law of the People＇s Republic of China which entered into force on January 1, 2008.and Regulations for the Implementation of Labor Contract Law of the People＇s Republic of China set up a framework standard and made labor dispatch swerve to the rule by law, the two-year practice showed that China＇s existing legal system of labor dispatch cannot meet realistic demands and there＇s still plenty of room for improvement.
