摘 要:我国的劳务派遣制度,经过了诱致性制度变迁和强制性制度变迁两个阶段,变迁的趋势均越来越不利于派遣工群体。从诱致性制度变迁看,这是派遣工与雇主之间制度供给能力和议价能力不对称造成的;从强制性制度变迁看,这是政府作为一个有自己偏好和利益的经济人理性选择的结果。因此,要改变这种趋势,提高派遣工的制度供给能力和议价能力,改变政府的偏好和利益格局,才是有实质意义的选择。The labor dispatching system in China has experienced two different stages, induced institutional change and mandatory institutional change, both of which are harmful and unfair to the workers who provide their labor and intelligence. On one hand, the change in the labor dispatching system is brought out by the imbalance between central players' regulation supply capacity and bargaining power from the point of view of induced institutional. On the other hand, the change could be a result from the rational choices of an economic government who has its own preferences and interests from the point of view of the mandatory institutional. Therefore, improving regulation supply capacity and bargaining power for workforces, as well as verifying government's preferences and patterns of interests, could bring more meaningful outcomes compared to standardizing the regulations and legislations on labor dispatching.
