摘　　要：在中国,有着异常发达的智谋文化传统。起源于战争的智谋文化,与儒家文化、道家文化等一样,是中国传统文化的重要组成部分。它深刻影响了中国人的思维方式与行为方式,并对法律文化传统产生了重要的影响。为国人所崇尚的智谋文化传统,对公平正义的社会秩序的建立构成了扭曲与损害,在本质上与法治的精神相悖,是中国传统文化中一项重要的反法治因素。In China, strategy culture has been exceptionally developed. Taking its origin in the war, strategy culture, like the Confucianist culture and the Taoist culture, is an important part of Chinese traditional culture. It has affected Chinese＇s thinking mode and the behavior way profoundly, and has had the important influence on the legal culture. Strategy culture caused the distortion and the harm to the establishment of a fair social order, is an important counter-government by law factor in the traditional Chinese culture.
