摘　　要：教育研究知识产权作为一种新兴知识产权形态,其受重视程度,随着教育投入、教育对社会经济发展的贡献率以及知识产权保护强度的不断提升而提升。论文利用外部性理论,从外部性表现和外部性的非效率问题等角度,对教育研究知识产权保护与共享机制的基本理论进行了规范性分析;从政府规制的角度,分析了外部性条件下的教育研究知识产权保护与共享机制的一些基本形式。As a new type of IPRs,with the increase of education investment,contribution made by education to the social and economic development and the strengthening of IPRs protection,education research IPRs is gaining more importance.Based on the externality theory,this paper analyses some basic theories about mechanism of sharing and protecting of education research IPRs from the viewpoints of externality＇s existence and the non-efficiency of it.In the end,this paper also analyses the basic forms of the mechanism adopted by government in the form of regulations on externality.
