调解人行为模式:在消极中立与积极干预之间

摘　　要：调解人中立不是任由当事人自由角力的消极中立,调解人干预也不是剥夺当事人自治的积极干预。调解人恰切的行为模式应当处于消极中立与积极干预之间。一方面,调解人的价值观可以适当渗透于调解过程,帮助当事人达成互利共赢的和解方案;另一方面,调解人的力量可以适度介入调解过程,平衡当事人间的力量关系。但不论是价值观渗透还是力量介入,都会将调解人置于偏离中立的伦理困境,而缓解这一困境的策略则要在实践知识中探寻。A mediator should be neutral between two parties,but it is not passive neutrality.A mediator should intervene between two parties,but it is not active intervention depriving the parties＇ self-determination.The appropriate behavior mode for a mediator is between passive neutrality and active intervention.On the one hand,a mediator can bring his/her some value into mediation process to help the parties achieve win-win settlement;on the other hand,a mediator can take his/her some power into mediation process to balance the parties＇ power.But either the value or the power of a mediator should not enter into the mediation,or it will make the mediator into an ethic dilemma.The methods solving this dilemma should explore in practice.
