摘  要:命题自主权是高等教育命题教师的重要权利。合理行使命题自主权,对于确保高等教育的质量和促进高等教育公平与公正均具有重大意义。命题教师的命题自主权包括了决定课程考核标准权、决定命题方式权、指导考生学习权、命题自治权、命题知情权、命题研究权和权利救济权等。与此同时,其权利也应受到相应的约束,这种约束力主要来自考试机构的管理权、考生的学习自由权和办学机构的教学权等。The independent rights to formulate questions for examination are important rights of the teachers that formulate questions for examination in higher education.Taking advantage of the independent rights to formulate questions for examination appropriately is significant for guaranteeing the quality of higher education and promoting the fairness and justice of higher education.Teachers' independent rights to formulate questions for examination include the right to decide standards of course examination,the right to decide the way of formulate questions for examination,the right to guide students how to study,the autonomous right to formulate questions for examination,the right of access to information,the right to do some research,and the right of rights remedy.Meanwhile,the rights of the teachers to formulate questions for examination should be restrained.The restrained forces mainly come from power of management of examination authority,power of learning freedom of examinees and power of teaching of educational institution.
