我国环境污染侵权责任的协调和拓展——以民法学与环境法学的沟通为视角

摘　　要：随着环境污染事件的频繁发生及其影响程度和范围的扩大,环境污染问题已经成为我国经济快速发展过程中出现的一个突出社会问题,相应的责任问题日益受到民法学和环境法学的共同关注和重视。但是,两个学界对于环境污染侵权责任问题存在不同的法学视阈。我国环境污染侵权责任立法采取的是民事立法和环境立法的双轨制,并在一定程度上分别反映了民法学界和环境法学界的理论研究成果,两个学界之间的沟通成为促进我国环境污染侵权责任的协调性和统一性的重要保证。与此同时,面对环境本身受到污染或破坏的民事责任问题以及新型环境风险侵权责任问题的双重挑战,我国环境法学与民法学需要进行更深入和更广泛的对话,以拓展我国环境污染侵权责任制度。Coupled with the frequent occurrence of environmental pollution, and the extension of its affecting degree and scope, environmental pollution issue has become a prominent social problem in the course of rapid development of China＇s economy. Corresponding responsibility problems are increasingly subjected to the common concern and attention of the circles of civil law and environmental law. However, there are different visual thresholds concerning the environmental pollution tort between the two circles. In China, what the legislation of the environmental pollution tort undertakes is the dual track system regarding the civil legislation and environmental legislation, reflecting to a certain degree the theoretical research results by the circles of civil law and environmental law. The communication between the two law circles has become an important guarantee for promoting the coordination and unitarity of the environmental pollution tort in China. Meanwhile, confronted with the dual challenge of the civil liability problem that the environment itself undergoes pollution or damage , and the problem concerning the new - type environmental risk tort liability, there should be more profound and extensive dialogue between the circles of environmental law and civil law to extend the environmental tort liability system in China.
