北京市海淀区176起餐饮服务活动行政处罚案例分析

摘　　要：目的通过分析餐饮服务行政处罚案例,找出《中华人民共和国食品安全法》颁布后餐饮服务经营活动中发生的违法问题,为提高行政机关执法能力提供依据。方法从违法主体的类别、行政处罚种类、违法行为案由3方面对海淀区卫生局卫生监督所2009年6月至2010年10月期间的176个餐饮服务活动行政处罚案卷进行结构化统计分析。结果未经许可从事食品经营活动,生产经营超过保质期限的食品和食品添加剂标签不符合要求,3类违法行为是餐饮服务活动执法中发现的主要违法问题,占总数的70%。罚种以罚款最多,没收违法所得最少。建议完善餐饮服务活动的法律法规和食品安全国家标准,加强法律法规的宣传,建立健全对没收物品处置相关工作程序,针对无证经营违法行为加强综合整治力度。Objective To find out the illegal phenomena in the operational activities regarding food and beverage（FB）service after the promulgation of the Food Safety Law of the People＇s Republic of China（hereinafter referred to as food Safety Law）and provide a basis for the law enforcement ability of the administration,by analyzing cases of administrative penalties related to FB service.Method Carry out a structured and statistical analysis of 176 cases of administrative penalties regarding FB service handled by the Health Inspection Institution of Haidian Health Board from June 2009 to October 2010,from the perspectives of subjects of the offenses,categories of administrative penalties,and causes of contravention.Results The unlicensed food business operation,the production and business operation of expired food,the non-standard use of food and food additive labels were the three main types of violations,accounting for 70% of total found during the process of law enforcement in the FB industry.Among all the penalties imposed in these cases,financial penalties were the most common while confiscations of illegal gains were the least common.Recommendation Improve the laws and regulations related to FB service,strengthen the national food safety standards,enhance the publicity of the Food Safety Law and its corresponding regulations,establish and improve the working procedures such as the disposal of confiscated articles,and intensify the comprehensive treatment of the illegal activity of unlicensed business operation.
