摘 要:虽然目前我国已在宪法、劳动合同法、就业促进法等相关立法中对农民工平等就业权进行保护,但城乡二元化的户籍法律制度的存在,国内相关立法与国际核心劳动标准的不一致,国内相关立法过于原则、操作性不强等,使得农民工平等就业权受到侵犯的现象还较为严重。我国应尽快废除户籍歧视法律,制定功能单一的《户籍法》,尽快制定《反就业歧视法》,成立专门的公平就业机会委员会,立法强化就业歧视侵害者的法律责任,以充分保护农民工的平等就业权。At present,although peasant workers′ right to equal employment is protected by Constitution Law,Labor Contract Law and Employment Promotion Law in our country,the infringement upon peasant workers′ right to equal employment is still serious because of following reasons:the existence of Dualism System of Household Register,the non-compliance between related domestic law and international key labor standard,the difficulty to operate related domestic law.We should abolish the discriminatory law of Household Register,publish new Household Law and Anti-discrimination on Employment Law,establish a special institution named Equal Employment Opportunity Commission,and strengthen the legal responsibility to invade equal employment as soon as possible,so as to fully protect the peasant workers′ right to equal employment.
